What happened

In September 2023, the U.S. Equal Employment Opportunity Commission settled its first AI-discrimination lawsuit. The defendant, iTutor Group, had used an AI hiring tool that automatically rejected female applicants over 55 and male applicants over 60. The settlement included $365,000 in monetary relief and a consent decree.

The EEOC's commentary at the time established the new floor: Title VII applies to AI hiring decisions regardless of whether the algorithm was designed to discriminate. The case set the precedent for state and federal enforcement that followed.
